It is very important for you to keep a record of the complaints or conversations with the management company or the landlord of your apartment building, especially when it comes to possible safety violations.
Under New York law, a tenant cannot sue their landlord unless they can prove notice. How is notice proved?
Say, for example, there is a leak in your ceiling that is causing a puddle in your building. You then notify your landlord about the leak, and they say that they will take care of it.
However, the leak is not taken care of, and someone slips and falls due to the puddle. That landlord can be sued if there is proof that they notified them of the leak in the first place.
If you sent an email to the landlord about the leak, notice could be proved by the existence of that email.
A photo or a video or a photo of the leak can also be used against the landlord by showing that the leak had been there for a significant period of time and the landlord should have taken care of it without notice.
