A divorce or separation will bring on many changes in a person’s life and sometimes continuing to live in the same place may no longer be feasible. It is not uncommon for a parent to notify the other that he or she plans to move, with the children, to another state to be closer to family, to take advantage of cheaper cost of living, upon accepting a new job, etc. This can be prevented by filing divorce paperwork with the court immediately.
Once a Petition for Divorce is filed the Automatic Temporary Restraining Orders or ATROs are immediately activated. The ATROs include the restraint that neither party can leave the State of California with the children without the approval of the other parent or the consent of the court. To do so would be considered a violation of a court order and could negatively impact any future child custody orders.
