So we received a call the other day from someone wondering how negligence interacts with the workers' compensation claim. And so, in Georgia the workers' compensation claim or the system is what is called the no fault system. What that means is you do not have to prove that the injury was the fault of the employer. Now, there are other things that have to happen you have to be what is called in the course and scope of your employment. Meaning you have to be really doing the job or the type of work that you were hired to do. You can't be on drugs you can't be on intoxicated by alcohol and you can't be horse playing Those are ways that the employer and the insurance company can deny your claim. So, stay safe.
